1. Acceptance of Terms
Welcome to Guitar Lessons Cape Town (“we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your use of the website at www.guitarlessonscapetown.co.za (the “Site”) and the services offered, including guitar lessons. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you may not access the Site or use our services.
2. Lesson Booking and Payments
Booking Confirmation: All lesson bookings are subject to availability and confirmation. A booking is only confirmed once payment is successfully processed.
Payment Terms: Payment for lessons (whether single or packages) must be made in advance unless otherwise agreed upon in writing. We accept payment methods as indicated on the Site.
Pricing: All lesson fees are quoted in South African Rand (ZAR) and are subject to change without prior notice.
3. Cancellation and Refunds
This section is subject to the Consumer Protection Act 68 of 2008 (CPA).
Cancellation by Student:
Cancellations made more than 24 hours before the scheduled lesson time will typically receive a full credit for a rescheduled lesson.
Cancellations made less than 24 hours before the scheduled lesson time will, at our discretion, result in the forfeiture of the lesson fee.
Cancellation by Instructor: If an instructor cancels a lesson for any reason, the student will be offered a full refund or a credit to reschedule the lesson at a mutually convenient time.
Refund Policy: Refunds, where applicable, will be processed back to the original method of payment within a reasonable time, in accordance with applicable South African consumer laws.
4. User Obligations
As a User of the Site and our services, you agree to:
Provide accurate, current, and complete information during the booking process.
Use the Site and services only for lawful purposes.
Ensure that any equipment used for online lessons (internet connection, camera, microphone) is functional and adequate.
Refrain from recording, reproducing, or sharing any lesson content without our express written permission.
5. Intellectual Property
All content on the Site, including text, graphics, logos, lesson materials, video, and audio recordings, is the property of Guitar Lessons Cape Town or its content suppliers and is protected by South African and international copyright and intellectual property laws.
You may not copy, reproduce, or distribute any instructional materials provided during lessons without our prior written consent.
6. Limitation of Liability
Guitar Lessons Cape Town, its instructors, affiliates, or employees will not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses, resulting from:
The use or the inability to use the service.
The cost of procurement of substitute goods and services.
Any unauthorized access to or alteration of your transmissions or data.
Any other matter relating to the service.
Your sole and exclusive remedy for dissatisfaction with the service is to stop using the service.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. You irrevocably consent to the exclusive jurisdiction of the South African courts in all disputes arising out of or relating to the use of the Site or our services.
